This is an application for bail moved on behalf of the applicant Shekhar Kumar involved in case Crime No. 133 of 2006 under section 2/3 of U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, Police station Saini, district Kaushambi.
Heard Sri Anirudh Kumar Mishra, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that the applicant is on bail in the cases shown in the gang chart and co-accused Bal Ram Singh alias Pintoo has been enlarged on bail by an order of this Court dated 28.7.2006 passed in Criminal Misc. Bail Application No. 15269 of 2006.
The learned AGA argued that the applicant is a man of criminal antecedents and in case of release on bail there is likelihood of his indulging in other offences.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant having been enlarged on bail in all the cases shown in the gang chart, I consider it to be a fit case for bail.
Let the applicant Shekhar Kumar involved in case Crime No. 133 of 2006 under section 2/3 of U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, Police station Saini, district Kaushambi, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned and an undertaking that he will not misuse the liberty of bail by indulging in the commission of crime or anti social activities after being released on bail.
