Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the alleged occurrence had taken place in the dark hours of night. In the morning the dead body was found and then the F.I.R. was lodged at about 6.50 a.m. on 15.5.2006. The applicant is not named in the F.I.R. but after one months of the alleged incident the name of the applicant came to light. The naming of the applicant is after thought.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicants Buddhan alias Ali Husain involved in case crime no. 256 of 2006 under Sections 302,34 I.P.C., P.S. Dudhara District Sant Kabir Nagar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
