Against the order impugned in the present writ petition statutory alternative remedy by way of Appeal under Rule 28 of Central Reserve Police Force Rules, 1975 has been provided for.

Writ petition is accordingly dismissed on the ground of availability of statutory alternative remedy.

However it will be open to the petitioner to file an application for condoning the delay in filing of the Appeal with reference to the facts which have been mentioned in paragraph 13,14 and 15 of this writ petition.  

On such application being filed the Appealate Authority would consider the same sympathetically and shall pass a reasoned speaking order accordingly at the earliest possible.
