This is an application for bail moved on behalf of the applicants Pappan and Guddu alias Gyanendra involved in case Crime No. 91 of 2006 under sections 379, 411, I.P.C., Police station Dadri, district Gautam Budh Nagar.
Heard Sri Satish Kumar Tyagi, learned counsel for the applicants, learned AGA and have perused the record.
The learned counsel for the applicants submitted that first information report was lodged twenty four days after the incident. The learned counsel argued that recovery of tractor was made from some other place and has been implanted. The learned counsel pointed out that engine number of the recovered tractor does not tally with the stolen tractor.
The learned AGA argued that recovery of stolen tractor was made from the possessions of the applicants.
I have taken into consideration the submissions advanced on behalf of both the parties.
The first information report about the theft of tractor having been made twenty four days after the incident and engine number of the recovered tractor being different, I consider it to be a fit case for bail.
Let the applicants Pappan and Guddu alias Gyanendra involved in case Crime No. 91 of 2006 under sections 379, 411, I.P.C., Police station Dadri, district Gautam Budh Nagar, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
