Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the name of the applicant has been disclosed by the witnesses. He was not named in the F.I.R. The co-accused Ram Sewak alias Sewak whose case was on the same footing has been released on bail by this court on 18.5.2005 in criminal misc. bail application no. 3064 of 2005, who is named in the F.I.R. the applicant is having no criminal antecedent.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Ram Prasad involved in case crime no. 8 of 2003 underSections 147,148,149,307,302,
304,201,504 I.P.C., and 7 Criminal Law Amendment Act P.S. Jalalabad District Shahjahanpur be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
