Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. During investigation the only evidence of extra judicial confession has been collected by the I.O. that is the statement of Smt Savitri Devi wife of Balkutti and there is no other evidence against the applicant. Co-accused Lotan and Nandi have been released on bail by this court on 3.10.2006 and 13.11.2006. The case of the applicant is on the same footing with the case of the applcant.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Shyam Lal Pal involved in Case Crime No. 102 of 2006, under Sections 364, 302, 201, 34, 467, 468, 471 and 420 I.P.C. Police Station Majhgawa, District Hamirpur be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
