Heard Sri K.R.Sirohi, the learned counsel for the petitioner and Sri Sankatha Rai, the learned senior counsel, assisted by Sri Vinod Kumar Rai and Sri Shiv Sagar Singh, for the respondents.
The trail court rejected the application for grant of temporary injunction. The appellate court allowed the appeal of the plaintiffs and issued an injunction restraining the defendants from interfering in the possession of the plaintiffs on the land and on the structures existing on it. Aggrieved, the defendants have filed the present writ petition.
After considering the submissions made by the learned counsel for the parties, I dispose of the writ petition with a direction that the parties will maintain status-quo on the spot as existing on today, till the pendency of the suit. I further direct the court to decide the suit itself within a period of one year from the date of the production of a certified copy of this order. It is made clear that the parties will not seek undue adjournment before the trial court.
The writ petition is disposed of.
