This is an application for bail moved on behalf of the applicant Akbar indicted in case crime No. 215 of 2006 under sections 3/5/8 of Prevention of Cow Slaughter Act P.S. Hapur Dehat District Ghaziabad.
Heard Shri Satyender Kumar Singh , learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that recovery of beef is said to have been made from the joint possession of the applicant and five co-accused. The learned counsel argued that there is no report of public analyst to support that the meat recovered was beef.
The learned A.G.A. submitted that the applicant was arrested at the spot and recovery of 50 Kg. beef was made from the spot.
I have taken into consideration the submissions advanced on behalf of both the parties.
The offences are triable by the Magistrate Ist class. The applicant is in jail for the last about 1\1/2 months. The recovery was made from the joint possession of the applicant and co-accused. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Akbar indicted in case crime No. 215 of 2006 under sections 3/5/8 of Prevention of Cow Slaughter Act P.S. Hapur Dehat District Ghaziabad , be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
