Dr. Raj Kumar Upadhyaya v. State Of U.P. And Others - WRIT - A No. 62822 of 2006 RD-AH 19467 (17 November 2006)
Hon'ble Amitava Lala,J.
Leave is granted to the petitioner to add as party respondent no.4 herein.
The dispute is with regard to withdrawal of two additional increments, which has been done by the Senior Finance and Accounts Officer on behalf of Director Education (Higher Education) U.P., Allahabad. According to learned counsel appearing for the petitioner that such order is passed without affording opportunity of hearing. Thus, in disposing the writ petition, we direct the respondent no.2 to consider the representation of the petitioner within a period of one month from the date of communication of this order upon giving fullest opportunity of hearing and by passing a reasoned order thereon. For the purpose of effective adjudication a copy of the writ petition along with its annexures can be treated as part and parcel of the representation.
Thus, the writ petition stands disposed of.
No order is passed as to costs.
