This writ petition has been filed for a relief that as the land of the petitioner has been acquired by the respondents, therefore, according to the Government Order, the petitioner is entitled to get an appointment in the respondent's organization in lieu of the land acquired. The respondent in the present writ petition is Indian Farmers Fertilizers Cooperative Limited (in short IFFCO).
A preliminary objection has been raised on behalf of the respondents Sri Vivek Ratan who has appeared on behalf of respondent No.3 that the present writ petition is not maintainable as the IFFCO is not instrumentality of the State for the purpose of Article 12 of the Constitution of India. He has placed reliance upon a Division Bench Judgment of this Court reported in 2006 (4) ALJ 71 Jyoti Kumar Malaviya Vs. Indian Farmers Fertilizers Cooperative Limited and others.
In view of the aforesaid fact, as the Division Bench of this Court has clearly held that the writ petition is not maintainable, as such, the writ petition is hereby dismissed as not maintainable. It is, however, open to the petitioner to make a representation to the relevant authority for his grievance or to approach any court of law as advised.
No order as to costs.
