Heard learned counsel for the petitioners.
As per own assertions of the petitioners a suit under Section 129-B of U.P. Zamindari Abolition & Land Reforms Act (hereinafter referred to as the Act) is pending which is filed for declaration of rights over the alleged occupation of the petitioners on the plot for which exchange has been allowed by the competent authority under Section 161 of the Act. In these circumstances since the suit is pending the rights, if any, of the petitioners can very well be adjudicated upon there. At this stage there is no ground for interference by this Court in exercise of jurisdiction under Article 226 of the Constitution of India. The writ petition is, therefore, dismissed.
