Heard learned counsel for the applicant, the learned A.G.A. and Sri R.K. Verma learned counsel for the complainant.
It is submitted by learned counsel for the applicant that in the present case the applicant is named in the F.I.F. Only on the basis of the doubt and suspicion, but after 7 days of the alleged occurrence the evidence of last seen has been collected by the I.O. and there is no other evidence against the applicant. The applicant is not having any criminal antecedents.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Om Prakash @ Net involved in case crime no. 368 of 2005 under Section 302 I.P.C., P.S. Hayatnagar District Moradabad be released on bail on his furnishing a personal bond and two sureties to the satisfaction of the Court concerned.
