Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. It was lodged on 8.7.2006 on 9.15 a.m. Thereafter, the statement of the witness Raghvendra was recorded on 15.7.2006 in which he disclosed the name of 3 accused persons. The applicant was named by him. Subsequently, the statement of Bhupendra was recorded on 18.7.2006,. He disclosed the name of the applicant also. According to his statement 4 persons committed the alleged offence , whereas in the F.I.R. it has been clearly mentioned that 3 unknown persons committed the alleged offence. The naming of the applicant is after thought.
Learned A.G.A. submitted that from the possession of the applicant as sum of Rs. 3000/- has been recovered.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Ram Kishan involved in Case Crime No. 228 of 2006, under Sections 394, 302, and 411 I.P.C. Police Station Shikohabad, District Firozabad be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
