Heard learned counsel for the applicant and the learned A.G.A.

It is submitted  on behalf of the applicant that no  body is named in the F.I.R.  No specific  source of light  is also mentioned in the F.I.R., except  that one of the robbers  was allegedly identified  in the light  of the  vehicles  plying  on the road. No exercise  in respect of identification  appears  to have been under taken. It is further  argued  that after 4 days  of the alleged incident the applicant  was taken into custody from his residence and his own money amounting to Rs. 1200/- was shown  to have been recovered from him at the alleged time and place along with one country made pistol and two live cartridges. In respect of the  recovery  of  country made pistol and cartridges  he has already been bailed out by this Court  vide order dated 11.5.2005 passed in Criminal Misc. Bail Application No.8516 of 2005. He is languishing  in jail  w.e.f. 9.2.2005

In view of the facts and circumstances mentioned  herein above and the submissions  made on behalf of the applicant and without entering into the merits of the case, the applicant   be released on bail.

Let the applicant Sharifuddin involved  in case Crime No. 9 of 2005, under Sections 394,302,411 I.P.C., Police Station Shivali, district Kanpur Dehat  be  enlarged on bail on his furnishing a personal bond and two sureties  each  in the like amount   to the satisfaction of the Court concerned.
