This is an application for bail moved on behalf of the applicant Dinesh Singh involved in case Crime No. 76 of 2006 under sections 147, 148, 149, 307, 308, 324, 325, 323, 504, 506, 352, 120-B, I.P.C. and section 7 of Criminal Law Amendment Act, Police station Dubhar, district Ballia.
Heard Sri A.K.Shukla, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that there is a cross case of the incident case Crime No. 76-A of 2006 under sections 147, 323, 504, 506, I.P.C. and co-accused Sudarshan Singh has been granted bail by an order of this Court dated 14.11.2006 passed in Criminal Misc. Bail Application No. 24907 of 2006 and the case of the applicant is analogous.
The learned AGA argued that the applicant and co-accused subjected to assault and inflicted injuries to seven persons.
I have taken into consideration the submissions advanced on behalf of both the parties.
There is cross case of the incident. No specific role has been assigned to the applicant. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Dinesh Singh involved in case Crime No. 76 of 2006 under sections 147, 148, 149, 307, 308, 324, 325, 323, 504, 506, 352, 120-B, I.P.C. and section 7 of Criminal Law Amendment Act, Police station Dubhar, district Ballia, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
