None appears on behalf of the appellant. In the last occasion only an illness slip was filed. However, learned counsel for the respondent contended that since the writ petition was filed challenging the order of suspension, and when now the entire inquiry proceeding is complete the writ petition become infructuous. In view of the above circumstance, we have directed the respondent counsel to serve notice upon the appearing counsel for the appellant and subject to the service the matter be placed in the supplementary list earlier, however, the matter was not taken up on such date. Today when the matter is taken up again none appeared on behalf of the appellant. Therefore, it can be safely said that the appellant has no interest in the case. The special appeal stands dismissed for non-prosecution.
No order is passed as to costs.
Interim order, if any, stands vacated.
