  Heard learned counsel for the applicants and the learned A.G.A.and Sri S.P.S. Rathore and Sri K.S. Chahar, learned counsel for the complainant.

        It is submitted by learned counsel for the applicants that  the applicant and five other co-accused persons discharged shots by rifle, gun, revolver and country made pistol. It is said that the applicants  were  armed with rifle. The deceased has received one firearm injury. It has not been specified as to whose shot hit the deceased neither in the F.I.R. nor in the statement of the witnesses recorded under section 161 Cr.P.C. The co-accused Ghanshyam has been released on bail by this court  on 5.10.2006 in criminal misc. bail application no.  21276 of 2006 and  co-accused  Ranbir and Sahab Singh have been released on bail by this court on 10.10.2006 in criminal misc. bail application no. 21849 of 2006.

In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case the applicants are  entitled to be released on bail.

Let the applicants Kamal Singh,, Raja Babu and  Bhanwar Singh  involved in case crime no. 135 of 2006 under Sections  147,148,149,302,504I.P.C.,P.S.  Iradat Nagar  District                          Agra  be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
