Daya Ram Singh v. State Of U.P. & Others - WRIT - C No. 63161 of 2006 RD-AH 19672 (21 November 2006)
Hon'ble Anjani Kumar, J.
Heard learned counsel for the petitioner and learned standing counsel.
The petitioner has approached this Court by means of this writ petition under Article 226 of the Constitution of India being aggrieved by the order dated 4th September 2006 whereby the Additional Commissioner has rejected the revision filed by the petitioner against the order of Sub-Divisional Officer dated 3rd August 2006. The order passed by the Sub-Divisional Officer concerned only permits the party to be impleaded. The trial court has allowed the application of the contestants directing impleadment of the applicants and the Additional Commissioner rejected the revision arising out of the order passed by the trial court. The revisional court held that none of the rights of the petitioner are adversely affected by impleadment of the applicants. In these circumstances the revision is rejected.
I do not find any error in the order passed and reasoning given by the Additional Commissioner in the impugned order which may warrant interference by this Court in exercise of jurisdiction under Article 226 of the Constitution of India. The writ petition is, therefore, dismissed.
