Challenge in this petition is the auction proceedings which is said to have taken place pursuant to the recovery process.
On own submission of the learned counsel auction has taken place which according to him is illegal for various reasons as stated in the writ petition. Be as it may, as petitioner has effective and alternative remedy to file his objection/appeal before the learned Commissioner as provided under the provisions of the U. P. Z. A. & L. R. Act/Rules and, therefore, petitioner is to take recourse as permissible in law.
In view of the aforesaid, this Court without going into merits of the matter declines to interfere in the matter on the aforesaid grounds.
Writ petition fails and is dismissed.
