  Heard learned counsel for the applicant and the learned A.G.A.

        It is submitted by learned counsel for the applicant that the applicant is the father of the deceased. According to the F.I.R. the marriage of the deceased was solemnized with the son of the applicant five years prior the alleged incident. It is stated that the deceased was having two children. According to the post mortem examination report the cause of death is hanging and except ligature mark no other injury was seen on her person. The allegation made against the applicant and other co-accused persons are general in nature. The applicant is having no concern with the demand of dowry and subjecting the deceased with cruelty. The case of the applicant is distinguishable with the case of other co-accused persons.

In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.

Let the applicant Ram Vishal Singh involved in case crime no. 82         of 2006  under Sections 498-A,304-B I.P.C.,  and ¾ D.P. Act    P.S. Naraini District Banda                        be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
