Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that in the present case the F.I.R. is too much delayed. It was lodged on 12.11.2006 at 1.05 p.m. in respect of the incident which had occurred on 28.8.2005 at about 7.30 p.m. The F.I.R. has been lodged on the basis of confessional statement made by the applicant before the first informant for which it is contended that he has not made any confessional statement and there is no other evidence against the applicant.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Jameel Ahmad involved in Case Crime No. 418 of 2005, under Sections 302 and 201 I.P.C. Police Station Shahi, District Bareilly be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned .
