Heard learned counsel for the petitioner.
The petitioner, by means of this writ petition, has challenged the order passed by the revisional court which is passed on the revision filed by the petitioner against the order of Sub-Divisional Officer dated 28th October 2002. The revisional court accepted the case set up by the petitioner and directed the Sub-Divisional Officer to decide the matter afresh after setting aside the order dated 28th October 2002 and after affording opportunity to the petitioner in accordance with law.
Admittedly the order impugned in the writ petition is a remand order and up till now no right of the petitioner has been adjudicated by the respondents. Learned counsel for the petitioner submitted that now the respondents are trying to dispossess the petitioner. I do not find that this statement of the petitioner is substantiated by any material. Even if it is so the petitioner can apply to the Sub-Divisional Officer with an application that he may not be dispossessed. In this way of the matter I do not find any force in this writ petition. It is accordingly dismissed.
