This is an application for bail moved on behalf of the applicant Raj Kumar indicted in case crime No. 239 of 2005 under section 364 I.P.C. P.S. Kalan District Shahjahanpur.
Heard Shri Alok Sharma, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that there is no First Information Report or report of disappearance of the victim. The learned counsel argued that the applicant has been falsely implicated due to village politics.
The learned A.G.A. submitted that the recovery of abductee was made from the kotha of applicant and the applicant was captured at the spot.
I have taken into consideration the submissions advanced on behalf of both the parties.
The victim has been recovered. There is no demand of ransom. No report about disappearance or missing of the victim was lodged by his family. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Raj Kumar indicted in case crime No. 239 of 2005 under section 364 I.P.C. P.S. Kalan District Shahjahanpur, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
