Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that according to the prosecution version the alleged occurrence has taken place in the dark hours of night at 8.00 on 18.104.22.1686. Its F.I.R. has been lodged on 5.9.2006 at 23.30 a.m. The applicant came at the place of occurrence and caused injury by using lathi blows. It has been specified that the applicant caused injury by rifle. According to the post mortem examination report the deceased has not received any injury caused by rifle, therefore, the manner of the occurrence was changed by alleging that the applicant caused injury by the butt of the rifle.
In reply to the above contention it is submitted by the learned A.G.A. that the applicant is having criminal antecedent.
Let the applicant Sabhajeet involved in case crime no. 120 of 2006 under Sections 302,323,504 I.P.C., P.S. Jafarganj District Fatehpur be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned with the condition that the applicant shall report to the Police Station concerned in the first week of each month till conclusion of the trial to show his good behaviour.
In default of the above condition it shall be open to the learned C.J.M. to cancel the bail of the applicant on police report.
