This is an application for bail moved on behalf of the applicant Shaukat indicted in case crime No. 160 of 2005 under sections 395, 397, 412 I.P.C. P.S. Sikandara District Agra .
Heard Shri Ram Rawat, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the name of the applicant came to light from the confessional statement of co-accused Deenu and recovery of looted truck was made from the possession of co-accused Deenu. The learned counsel urged that no test identification parade was conducted.
The learned A.G.A. argued that the applicant and co-accused looted the truck and loaded goods and recovery of the truck was made from the possession co-accused Deenu.
I have taken into consideration the submissions advanced on behalf of both the parties.
No recovery having been made from the possession of the applicant, I consider it to be a fit case for bail.
Let the applicant Shaukat indicted in case crime No. 160 of 2005 under sections 395, 397, 412 I.P.C. P.S. Sikandara District Agra, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
