Shyam Singh Yadav v. State Of U.P. And Others - WRIT - A No. 63320 of 2006 [2006] RD-AH 19835 (22 November 2006)
|
Hon'ble Amitava Lala,J.
Hon'ble V.C.Misra,J.
Learned counsel for the petitioner is permitted to delete the names of the respondent nos. 4 to 7 from the role of the respondents. It appears from the instructions as obtained by learned Chief Standing Counsel that the Ministry of Sports Government of India has not yet issued permission to the petitioner to coach the players of national shooting team. According to learned counsel appearing for the petitioner that normally such permission is granted after obtaining permission from the State. We find that there is an order of Division Bench of this Court dated 22nd January, 2000 in writ petition no. 297 (M/B) of 2000 ( Shyam Singh Yadav Vs State of U.P. and others ) on the similar circumstance. We do not find any reason to deviate from passing similar order.
Therefore the State is directed to take immediate step to allow the petitioner to proceed for coaching of the Asian Games players of National Shooting team. However such order will be effective subject to permission granted by the Ministry of Sports Government of India. This is required for national interest.
The writ petition is accordingly disposed of.
No order is passed as to cost.
A copy of the instruction obtained by learned Chief Standing Counsel be kept with the record.
