It is submitted by learned counsel for the applicant that according to the prosecution version the alleged occurrence had taken place in the night of 13/14.9.2005. The applicant and other co-accused persons were arrested on 12.10.2005. It is said that the applicant has made a confessional statement before the police and there is no evidence against the applicant and nothing has been recovered from the possession of the applicant or his pointing out.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Sudhir involved in Case Crime No. 137 of 2005, under Sections 302, 394/34 I.P.C. Police Station Dhaulana, District Ghaziabad be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned .
