This is an application for bail moved on behalf of the applicant Sultan Singh indicted in case crime No. 221 of 2006 under sections 342, 364-A, 394, I.P.C. P.S. New Agra District Agra.
Heard Shri Anil Srivastava, learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the applicant is not named in the First Information Report or in the statement of the abductee. The learned counsel urged that the name of the applicant came to light from the statement of co-accused Manoj Kumar and Raman Yadav.
The learned A.G.A. submitted that recovery of mobile set of abductee was made in pursuance of the disclosure statement of the applicant.
I have taken into consideration the submissions advanced on behalf of both the parties.
The abductee managed his escape from the clutches of miscreants. The abductee has not named the applicant in his statement under section 161 Cr.P.c. The name of the applicant figured in the confessional statement of the co-accused. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Sultan Singh indicted in case crime No. 221 of 2006 under sections 342, 364-A, 394, I.P.C. P.S. New Agra District Agra, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
