Heard learned Counsel for the applicant, learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is father-in-law of the deceased. He is old man aged about 70 years. He is suffering from asthma. He was having no concerned with the demand of dowry and subjecting the deceased with cruelty. The case of the applicant is distinguishable with the case of other co-accused.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Suresh involved in Case Crime No. 120 of 2006, under Sections 498-A and 304-B I.P.C. and Sections ¾ Dowry Prohibition Act. Police Station Jalesar , District Etah be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned
