Since the impugned order dated 18.10.2006 is only an interim order with direction for affidavits and five weeks out of eight have passed after which the matter is again to be listed before the Hon'ble Single Judge, the appeal should not be entertained. At this stage, it is dismissed without prejudice to the rights and contentions of the parties.

We have not entered into the merits of the case in any substantial manner.
