Heard learned counsel for the petitioner Sri Anil Kumar Bajpai and the learned counsel Sri Sanjiv Singh for the respondents.
A notice under section 13 (4) of the Securitization and Reconstruction of financial Assets and Enforcement of Security Interest Act, 2002 has been given to the petitioner. The petitioner has an alternative remedy by way of filing an appeal under Section 17 of the aforesaid Act. In case the petitioner files an appeal within a period of three weeks, the same shall be decided on merits within six weeks thereafter.
Till the decision of the aforesaid appeal, the property of the petitioner shall not be auctioned.
With the aforesaid directions, the writ petition is disposed of.
