Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is named in the F.I.R. has been lodged after 4 days of the alleged occurrence, but after two months of the alleged occurrence it is alleged that at the pointing out of the applicant one scarf and one razor, used in the commission of the alleged occurrence were recovered from a river bank. The recovery was not supported by any independent witness. It is too much delay. There is no other evidence against the applicant.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Makhanchoo involved in case crime no. 95 of 2006, under Sections 1302 and 201 I.P.C., P.S. Nawabganj District Allahabad be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
