Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. the name of the applicant has been disclosed by co-accused Tejveer Singh and Kuldeep Singh. There is not other evidence against the applicant. Nothing incriminating has been recovered from the possession of the applicant or at his pointing out. Co-accused Tejveer Singh and Kuldeep Singh have been released on bail by this court on 30.10.2006 in Criminal Misc Bail Application No.22860 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Mukesh involved in case crime no. 171 of 2006, , under Sections 302 and 120-B/34 I.P.C. P.S. Sadar Bazar District Meerut be released on bail on his furnishing a personal bond and two sureties to the satisfaction of the Court concerned with the condition that the applicant shall report to the court of learned C.J.M. in the first week of each month about his behaviour and good conduct till the conclusion of the trial and the applicant shall not tamper with the evidence.
In default of the above condition the bail granted to him shall be deemed cancel.
