Heard learned counsel for the applicant and the learned A.G.A. and Sri K.K. Singh and Sri A.N.Srivastava, learned counsel for the complainant.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. During investigation the statement of witnesses Ashutosh Singh and Mahendra Singh were recoded. According to their statements the role assigned to the applicant is of exhortation the role of causing injury is assigned to the co-accused Awadh Bihari Sahni and Guddu Ram.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Naveen Rai involved in case crime no. 1540 of 2006 under Sections 302 I.P.C., P.S. Kotwali District Ghazipur be released on bail on his furnishing a personal bond and two heavy local sureties each in the like amount to the satisfaction of the Court concerned.
