Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant has been named in the F.I.R. on the basis of doubt and suspicion. During investigation the confessional statement of the co-accused Jata Shanker was recorded who stated that the applicant caught hold the deceased at the time of commission of the murder. The statements of Shiv Pratap and Uma Shanker were recorded who stated that the applicant was seen near the place of occurrence. There is no direct eye witness account. There is no evidence against the applicant.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Ram Newaj Patel involved in case crime no. 106 of 2006 under Sections 302 I.P.C., P.S. Manda District Allahabad be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
