This is second bail application moved on behalf of the applicant Ikhlaq involved in case Crime No. 89 of 2005 under sections 302, I.P.C., Police station Mau Aima, district Allahabad.
Heard Sri Kamal Krishna, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that the informant and eye witness Gulzar have not supported the prosecution case in their testimony in the trial.
The informant and named eye witness having not supported the prosecution case in their testimony before the court, I consider it to be a fit case for bail.
Let the applicant Ikhlaq involved in case Crime No. 89 of 2005 under sections 302, I.P.C., Police station Mau Aima, district Allahabad, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
