Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the alleged occurrence has taken place in the dark hours of night at about 3.30 a.m. on 8..8.2006, its F.I.R. was lodged on 8.8.2006 at about 6.30 a.m. under section 307 I.P.C. Nobody is named in the F.I.R. as an accused even the name of the applicant has not been disclosed by the injured. Subsequently the statement of the first informant was recored in which he did not disclose the name of the but he disclosed the name of the applicant in the second statement by saying that the alleged incident was witnessed by the persons who were sleeping along with the deceased. The naming of the applicant is after thought.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Udai Kumar Bind involved in case crime no. 64 of 2006 under Sections 302 I.P.C., P.S.Dheena District Chandauli be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
