This is an application for bail moved on behalf of the applicant Ulfat Husain alias Saiful Islam involved in case Crime No. 1308-A of 2002 ( S.T.No. 974 of 2002) under section 5 of Explosive  Substance Act, Police station Katghar, district Mordabad.

Heard Sri K.D. Tiwari, learned counsel for the applicant, learned AGA and have perused the record.

The learned counsel for the applicant submitted that co-accused `Mohammad Taqi alias Kari Taki and Rizwan Haider have been granted bail by an order of this Court dated  9.3.2005 and 22.8.2005 passed in Criminal Misc. Bail Application No. 15995 of 2005 and the case of the applicant is identical. The learned counsel urged that the applicant has been acquitted in the POTA case.    

The case of the applicant being analogous to co-accused Rizwan Haider and Mohammad Taqi alias Kari

Taqi, I consider it to be a fit case for bail.

Let the applicant Ulfat Husain alias Saiful Islam involved in case Crime No. 1308-A of 2002 ( S.T.No. 974 of 2002) under section 5 of Explosive  Substance Act, Police station Katghar, district Mordabad, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
