Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. It is said that 3 unknown miscreants committed the alleged offence, but after 26 days of the alleged offence some persons claimed themselves to be eye witnesses and they disclosed the name of the applicant. The naming of the applicant is after thought.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Ahsan alias Bhura involved in case crime no. 143 of 2006, , under Section 302 and 120-B I.P.C. P.S. Saroorpur District Meerut be released on bail on his furnishing a personal bond and two sureties to the satisfaction of the Court concerned.
