Heard C. P. Singh, learned counsel for the applicants, learned A.G.A. and perused the record.
Prosecution case is that accused and other co accused were found taken 2 cows and 6 calf in cruel manner for slaughtering them.
Learned counsel for the applicants has contended that applicants have been falsely implicated and they are farmers and has purchased these cattle and there can be no presumption that they were taking them for slaughtering purpose.
In the circumstances of the case, but without prejudice to the merits of the case, accused are entitled to bail.
Let the accused Nafees and Yunus involved in Case Crime NO. 626 of 2005 under Section 3/5A/8 of U.P. Prevention of Cow Slaughter Act 1955 and Section 10/11 of Animal Cruelty Act, P.S. Adampur, District J. P. Nagar be released on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned. They shall also give an undertaking that they will not indulge in any criminal activity. If any adverse report is made against them, it shall be open for the Court below to report to this Court so that their bail may be cancelled.
