Dr. Harish Chandra Gupta v. State Of U.P. And Others - WRIT - A No. 64843 of 2006 RD-AH 20108 (28 November 2006)
Hon'ble Amitava Lala,J.
The order dated 21st September, 2006 was passed by this Court in writ petition no. 52721 of 2006 to consider the grievance of the petitioner to get the salary for officiation as Principal. It has been revised by the authority concerned. However, since we have already held that the person concerned who is officiating on the post of Principal will get the salary for such period equivalent to the Principal in earlier occasion, the similar order is passed hereunder.
However, in disposing the writ petition, we direct the petitioner to make a representation before the authority concerned within a period of one week from the date of receiving the certified copy of this order and the authority concerned shall consider the representation upon giving fullest opportunity of hearing and by passing a reasoned order thereon within a period of one month from the date of representation. For the purpose of effective adjudication a copy of the writ petition along with its annexures can be treated as part and parcel of the representation.
Thus, the writ petition is disposed of.
However, no order is passed as to costs.
