Sri P.N.Ojha, learned counsel appeared for the respondent no.3. By making an order dated 13th October, 2006 the respondent authority made an order of recovery of the amount by way of adjustment from the gratuity and leave encashment when the petitioner had retired on 30th June, 1998. The petitioner had no knoweldge about any proceeding against him for such recovery. Under such circumstance the petitioner is directed to make a representation before the authority concerned within a period of one week from the date of receiving the certified copy of this order and the authority concerned shall consider the representation upon giving fullest opportunity of hearing and by passing a reasoned order thereon. For the purpose of effective adjudication a copy of the writ petition along with annexres can be treated as part and parcel of the representation.
However, till one week after making a representation no effect or further effect of the impugned order dated 13th October, 2006 will be given.
Thus, the writ petition stands disposed of.
No order is passed as to costs.
