This is an application for bail moved on behalf of the applicant Malkhan involved in case Crime No. 804 of 2006 under section 5/25 Arms Act, Police station Kotwali Mahoba, district Mahoba.
Heard Sri Neeraj Tripathi, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that the applicant is in jail since July 2006 and offences are triable by the Magistrate Ist class. According to the learned counsel there is no criminal history of the applicant.
The learned AGA argued that recovery of instrument and material used for manufacturing of illicit country made pistol, cartridge etc. was made from the place out side the room of co-accused Nand Ram.
I have taken into consideration the submissions advanced on behalf of both the parties.
The offences are triable by the Magistrate Ist class. The applicant is in jail for the last about four months. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Malkhan involved in case Crime No. 804 of 2006 under section 5/25 Arms Act, Police station Kotwali Mahoba, district Mahoba, be released on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
