Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. whereas co-accused Santar Pal and Raj Bahadur were named in the F.I.R., but on 3.10.2006 the statements of Moolraj and Rajeev were recorded. They disclosed the name of the applicant also. The alleged occurrence had taken place on 17.4.2006 at 7.00 a.m. in respect of the incident which had occurred on 17.4.2006 at 8.30 a.m. The naming of the applicant is after thought. There is no other evidence against the applicant.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Raj Kumar involved in Case Crime No. 289 of 2006, under Sections 147, 148, 149, 302, 307 and 120-B I.P.C., Police Station Hapur Nagar, District Ghaziabad be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned
