Heard Sri Dur Vijay Singh, learned counsel for the applicants and learned AGA and have perused the record.
The learned counsel for the applicants submitted that civil litigation in respect of Khasra nos. 135 measuring 0.18 decimal and 136 area 0.06 decimal is pending before the civil court. The learned counsel argued that dispute in relation to the said plots is also pending before the revenue court.
Issue notice to the respondent no. 2 for filing counter affidavit within four weeks. The learned AGA may also file counter affidavit within the said period. Rejoinder affidavit may be filed within two weeks thereafter.
Further proceedings in criminal complaint case No. 188 of 2002- Lajjawati Versus Ram Chandra and others, under sections 420, 467, 468, 504, 506, I.P.C., Polie station Maudarwaja, district Farrukhabad, shall remain stayed till the next date of listing.
