Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant and four other co-accused persons named in the F.I.R. which was lodged on 15.8.2006 at about 11.00 a.m. in respect of the incident which had occurred on 11.8.2006. The F.I.R. has been lodged only on the basis of doubt and suspicion. There is no direct eye witness account. During investigation only evidence of extra juridical confession has been has been collected by the I.O. for which it is contended that the applicant has not confessed before any persons.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Ram Jeet Yadav involved in case crime no. 116 of 2006 under Sections 302,201,34 I.P.C., P.S. Rasra District Ballia be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
