Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that in the present case an information regarding missing of the deceased was given to the police station on 3.6.2006 at 3.20 p.m., thereafter th F.I.R. of this case has been lodged on 3.6.2006 in which the applicant and co-accused Jumman were named. The naming of the applicant was only on he basis of evidence of last seen. It is further contended that the recovery of belt used in the commission of the alleged occurrence has been shown at the pointing out of the applicant. The recovery was planted by the I.O. Thee is no direct eye witness account. Co-accused Jumman has been released on bail by this court on 3.11.2006 in Criminal Misc. Bail Application No. 23652 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Saiyad alias Shamsher involved in case crime no. 472 of 2006, , under Sections 364, 302 and 201 I.P.C. P.S. Maudha District Hamirpur be released on bail on his furnishing a personal bond and two sureties to the satisfaction of the Court concerned.
