Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. During investigation the only evidence of extra judicial confession has been collected by the I.O. for which it is contended that the applicant has not confessed before any one. There is no direct eye witness account. There is no evidence against the applicant.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Suheb alias Raja involved in case crime no. 610 of 2006 under Sections 302 I.P.C., P.S. Sahibabad District Ghaziabad be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
