The writ petition for the third relief is not maintainable because the persons against whom an arrest order is being sought by way of mandamus have not been impleaded as respondents in this petition.
Further, during argument, learned counsel for the petitioners has confined the prayer to getting the petitioners' representation decided by the State Government-respondent No. 1. The petitioners are complainants and witnesses in a murder case. They want the investigation to be transferred from the local police, because of their apprehension, to C.B.,C.I.D. If such request is made along with detailed facts, the respondent No. 1 will examine the representation and issue such directions as may be considered appropriate whether to transfer or not to transfer the case to C.B.,C.I.D., or other agency. The decision will be taken within a month of the date on which the representation is received along with certified copy of this order.
The writ petition is disposed of as above.
