Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. The role of causing the injury is assignd to co-accused Badarey Alam, but during investigation the I.O. has collected the evidence showing that the applicant was instrumental in the commission of the alleged offence. It is alleged that there is no cogent evidence of such nature.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Abdul Kalam involved in Case Crime No. 217 of 2006, under Sections 302 and 120-B I.P.C., Police Station RAunapar , District Azamgarh be released on bail on his furnishing a personal bond and two heavy sureties each of the like amount to the satisfaction of the Court concerned.
